Confidential Policy

This Confidential Policy (hereinafter, the Policy) determines the procedure of receipt, storage, processing, use and transfer of personal and other data, which are provided by the User while using the site http://ohmybigplan.com/ (hereinafter, the site). If you do not agree with this Policy terms, we ask you to stop using the Site immediately.

1. Terms and definitions

  • 1.1. Terms and definitions, used in this Policy, shall have the meaning determined below:
    • Controller – limited liability Company “Oh My Big Plan OU”, established and registered according to the laws of Republic of Estonia, ID code 16529889.
    • User – individual, who uses the Site.
    • Site – set of data (texts, graphic and design elements, photo, video and other results of intellectual activity, computer programs), which are interconnected, contained in information system, and ensure the availability of this information for end users and are published at the address: http://ohmybigplan.com/.
    • Personal Data – data or set of information about individual, who is identified or may be specifically identified, and which are provided by the User personally, or may be collected while using the Site by the User.
  • 1.2. Headings in this Policy are specified for convenience only and do not affect the interpretation of Privacy Policy clauses.
  • 1.3. In case if the terms and definitions used in this Policy are not determined by this Section of the Policy, the interpretation of such term or definition shall be performed according to the text of this Policy. In case of lack of unambiguous interpretation of the term or definition, there is a need to interpret this term based on the rules of understanding of such terms and definitions on the Internet.

2. Collection of personal data and other information

  • 2.1. Information about the User that may be collected in accordance with this Policy includes:
    • 2.1.1. The information received from the User, in particular:
      • - Name and surname
      • - Phone number
      • - E-mail
      • - Address
      • - Other data that may be deemed personal.
    • 2.1.2. Except of the abovementioned information the information received while using the Site may also be collected:
      • - Cookies files
      • - IP-address of the User
      • - User behavior on the Site.
  • 2.2. You must be fully aware that you give the consent to the Controller to collect, use and transfer of personal data according to the provisions and conditions, specified in this Policy.
  • 2.3. You have the right not to transfer your personal data to us, but in such a case the Site and services may work incorrectly or part of their functionality will be unavailable.
  • 2.4. Site is not intended for children under 18 years old. We do not collect information from the visitors, which belong to this age group. We ask parents to discuss the use of the Internet network and transfer of information to the network with your children.
  • 2.5. The technology called "cookie" may be used on the Site. Cookie – small text files, which contain information, which are stored on the computer while visiting the web-page. They provide additional functionality of the Site and help us analyze using the Site.
    • 2.5.1. There are two types of cookie files: cookie files of one type are used for “remembering” of such information, as user name and password, and are stored on computer until you decide to unsubscribe. If you do not use the function like “Remember user name and password”, then such files will not be stored on your computer.
    • 2.5.2. Another type of files – sessional cookie. For example, they are used to track, which language you have chosen to display the web page. While visiting the Site such cookie files are stored temporarily in the memory of your computer. Sessional cookie files are not stored on your computer for a long time and usually are deleted when you close the web-browser window.

The Controller may automatically collect impersonal information of the User, i.e. information, which does not give the possibility to identify the User directly or indirectly, in particular about the User’s browser type or information about the site, from which the User has moved to the Seller’s site.

3. Why we process personal data and terms of its storage

  • 3.1. We collect information about name and surname, e-mail, phone number for the purpose of arrangement and realization of cooperation between us, and also to exchange information with you, including for sending information of marketing character about our activity.
    Such information shall be stored for three years from the moment of filling out of the special form on the Site, unless otherwise is specified by the legislation of Republic of Estonia.
  • 3.2. Information about Cookies files, User IP-address, User behavior on the Site is collected for adaptation of marketing and advertising events, which are proposed on the Site, and control of the general and individual Users activities.
    Such information shall be stored for three years from the moment of the last activity of the User on the Site, unless otherwise is specified by the legislation of Republic of Estonia.
  • 3.3. Except of the abovementioned, we can use the received information for the following purpose:
    • 3.3.1. For traffic monitoring, from which you receive the access to the Site; browser type and operating system, which are used for the access to the Site; date and time of your access to the Site; pages, which you visit, and internet-addresses of the site, from which you received the access to our Site.
    • 3.3.2. For recognition of repeated visitors (for analytical/statistical purpose).
    • 3.3.3. For anonymous tracking of interaction with internet advertising (for observation of the number of reflections and clicks on advertising banners).
  • 3.4. We may use your personal data within the company of Controller for the purpose of arrangement of cooperation between us. In any way, it shall be performed in compliance with this Policy.

4. User’s rights

  • 4.1. User enjoys all the rights, prescribed by the Law of Republic of Estonia on personal data protection, including:
    • 4.1.1. To know the purpose of personal data processing, sources of their collection and location of personal data
    • 4.1.2. To access to their personal data
    • 4.1.3. To refuse to process their personal data or forbid to use their personal data
    • 4.1.4. To ask to change their personal data
    • 4.1.5. To recall the consent on processing their personal data
    • 4.1.5. To refuse to receive materials of advertising nature.

  • 4.3. The User shall have the right to file a complaint with the Estonian Data Protection Inspectorate.

5. Transfer of personal data

  • 5.1. Personal data indicated on the Site shall not be provided to the third parties, except for the following cases:
    • 5.1.1. After receipt of the User’s consent, to whom this information belongs.
    • 5.1.2. At the reasonable request of the state bodies, which have the right to receive such data.
    • 5.1.3. For protection and defense of the Controller’s rights.
    • 5.1.4. For insurance of the security of the Site users.
  • 5.2. We may provide your impersonal personal data (those, which do not allow identifying you) to the third parties.
  • 5.3. In all other cases, before transferring of the information about you to the third parties we undertake to receive your consent.
  • 5.4. Personal data may be transferred to the companies, which work on our behalf. We cooperate with other companies, which perform functions of business support on our behalf, in connection with which your personal information may be partially disclosed. We demand these companies to use the information only with the purpose of services rendering according to the agreement; they are forbidden to transfer this information to other parties in situations other than when it is due to necessity of agreed services rendering. Examples of business support functions: fulfillment of orders, implementation of applications, issuance of prizes and bonuses, conducting customer surveys and managing of information systems. We do not perform management and are not responsible for the content and methods of confidentiality insurance of such third parties’ web sites, which may be related to our Site.   • 6.2. We strongly recommend you to get acquainted with methods of ensuring confidentiality on such third parties’ sites before using them.

7. Anti-spam policy

  • 7.1. Spam is unacceptable for us, we do not send letters to anyone without consent, we do not sell and rent out e-mails to unauthorized third parties. It does not mean that we may predict spam appearance on the Internet. If you believe that you have received unsolicited mail from us, please contact us.

8. Security

  • 8.1. We use modern technologies of ensuring confidentiality of personal data, received from the register forms, which the Users leave, with the purpose of maximum protection of information ensuring.
  • 8.2. Collection, storage, use, processing, disclosure of information, received by us as a result of private individual visit (visitor or user) of our Site and/or filling in the registration forms, including personal data of users, are carried out by us in accordance with current laws of Republic of Estonia. Individual (visitor or user) is aware and gives his/her consent for collection and processing of his/her personal data by the Controller within the limits and for the purpose, prescribed by provisions of this Policy according to current laws of Republic of Estonia.

9. Final provisions

  • 9.1. By visiting the pages of the Site and/or by filling in the special form on the Site, the User gives his/her consent for personal data processing and accepts terms of this Policy.
  • 9.2. Terms of this Policy may be amended by us unilaterally. Amendments in this Policy shall enter into force from the moment of their publication on the Site. Your following use of the Site after publication of any amendments to this Policy indicates your consent with these amendments.
